Acceptance of Terms

By accessing or using the startfig.com website, mobile application, or any services offered by Fig Health, Inc. ("Fig," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services. These Terms constitute a legally binding agreement between you and Fig.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of the Services after such changes constitutes acceptance of the revised Terms.

Description of Services

Fig provides a digital platform that connects users with independent, licensed healthcare providers for telehealth consultations related to weight management, including evaluation for physician-prescribed compounded medications such as semaglutide and tirzepatide. Our Services include:

Online health intake forms
Asynchronous and synchronous telehealth consultations
Prescription fulfillment coordination through licensed compounding pharmacies
Related educational content

Important: Fig is a technology platform that facilitates access to telehealth services. Fig does not practice medicine, provide medical advice, or prescribe medications. All clinical decisions are made solely by independent, licensed healthcare providers. Compounded medications are not FDA-approved and have not been evaluated by the FDA for safety, efficacy, or quality.

Eligibility

To use our Services, you must:

Be at least 18 years of age
Reside in a state where our partnered healthcare providers are licensed to practice
Be legally capable of entering into a binding contract
Provide accurate and complete health information during the intake process

Fig's Services are not available in all states. Certain states impose restrictions on telehealth prescribing, compounding, or the dispensing of specific medications. You are responsible for confirming that telehealth services and compounded medications are available and legal in your state of residence. Fig reserves the right to decline service based on geographic eligibility.

Account Registration and Accuracy

You agree to provide truthful, accurate, and complete information when creating an account and completing health intake forms. Providing false or misleading health information may result in inappropriate medical care and constitutes a violation of these Terms. You are responsible for maintaining the confidentiality of your account credentials.

Telehealth Services and Medical Disclaimers

Telehealth consultations are conducted by independent, licensed healthcare providers who are not employees of Fig. These providers exercise independent medical judgment and are solely responsible for the clinical care they deliver.

Fig does not guarantee that you will receive a prescription. Prescribing decisions are made at the sole discretion of your healthcare provider based on your medical history, health intake, and clinical evaluation. Not all patients are eligible for GLP-1 or other weight management medications.

The information provided on the Fig website, including blog posts, FAQs, and educational materials, is for general informational purposes only and does not constitute medical advice. Always consult with a qualified healthcare provider regarding any medical condition or treatment.

Compounded Medications

If your healthcare provider determines that a compounded medication is appropriate for you, the prescription will be fulfilled by a licensed, state-regulated compounding pharmacy that operates independently from Fig. Fig does not manufacture, compound, or dispense medications.

Compounded medications are not FDA-approved. They have not been evaluated by the FDA for safety, efficacy, or quality. Compounded medications are prepared based on a prescriber's order for an individual patient. The actual product appearance and labeling of medication you receive will differ from website imagery.

Pricing, Payment, and Refunds

All fees for Fig's Services are displayed at the time of purchase. Fig operates on a subscription basis. You authorize Fig to charge the payment method on file for recurring subscription fees until you cancel.

Refund Policy

If you are deemed medically ineligible after your initial consultation, you may cancel and receive a refund for the current billing cycle.
If you cancel before your scheduled consultation for the current billing period, you may receive a refund for that period.
Refunds for prior billing periods will not be issued.

To request a cancellation or refund, contact us at support@startfig.com. Fig's Services are not covered by health insurance. You may be able to use HSA or FSA funds for eligible expenses — confirm eligibility with your plan administrator.

Prohibited Conduct

You agree not to:

Use the Services for any unlawful purpose
Provide false health or identity information
Attempt to obtain medications for someone other than yourself
Interfere with or disrupt the Services or servers
Resell, sublicense, or redistribute any aspect of the Services
Use automated systems to access the Services without prior written consent from Fig

Intellectual Property

All content on startfig.com — including text, graphics, logos, images, software, and the overall look and feel of the platform — is the property of Fig Health, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES. FIG'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO FIG IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Fig does not assume liability for clinical decisions made by independent healthcare providers or for the safety, quality, or efficacy of compounded medications dispensed by independent pharmacies.

Indemnification

You agree to indemnify and hold harmless Fig Health, Inc., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your provision of inaccurate health information.

Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of New Jersey.

You agree to waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of laws provisions.

Termination

Fig may suspend or terminate your access to the Services at any time, with or without cause and with or without notice. Upon termination, your right to use the Services will immediately cease. Sections 9, 11, 12, 13, and 14 survive termination.
